התנאים האלה חלים על השימוש באפליקציה SmartPilot Waitlist ("האפליקציה"), שמפעילה SMART BUILD LTD (SmartPilot) ("אנחנו"). התקנת האפליקציה או שימוש בה מהווים הסכמה לתנאים.

מה האפליקציה עושה

האפליקציה מיועדת לבעלי עסקים שמשתמשים ב-Wix Bookings. לקוחות של העסק נרשמים לרשימת המתנה בעמוד השירות באתר של העסק. כשתור מתבטל או נדחה, הממתינים המתאימים מקבלים הצעה עם קישור להזמנה, ומי שמזמין ראשון מקבל את התור. התור לא נשמר לאף אחד.

רישיון שימוש

אנחנו מעניקים לבעל העסק רישיון להשתמש באפליקציה כל עוד היא מותקנת באתר שלו.

אחריות בעל העסק

  • לבעל העסק יש הסכמה לפנות ללקוחות שנרשמים לרשימת ההמתנה.
  • בעל העסק עומד בחוקי הפרטיות והדיוור במדינה שלו.

מנויים ותשלומים

  • חינמי: התראות לבעל העסק בלבד.
  • ניסיון של 14 יום מההתקנה: הצעות אוטומטיות במייל, עד 100 מיילים, בלי כרטיס אשראי.
  • בסיסי ומקצועי: בתשלום חודשי או שנתי.

התשלומים מתבצעים דרך Wix, לפי התנאים של Wix, וגם הביטול וההחזרים מתבצעים דרכה. אפשר לבטל בכל עת. בהמשך ייתכנו גם הודעות וואטסאפ.

הגבלת אחריות

  • אין התחייבות שכל תור שמתפנה יתמלא.
  • אין התחייבות לזמינות רצופה של האפליקציה.
  • אין אחריות לנזק עקיף.

איך האפליקציה מטפלת במידע מוסבר במדיניות הפרטיות של האפליקציה.

שינויים בתנאים

על שינויים בתנאים נודיע מראש באתר.

דין וסמכות שיפוט

על התנאים האלה חל הדין הישראלי, וסמכות השיפוט נתונה לבתי המשפט בישראל.

These terms apply to the use of the SmartPilot Waitlist app (the "App"), operated by SMART BUILD LTD (SmartPilot) ("we", "us"). Installing or using the App means you accept these terms.

What the App does

The App is for business owners who use Wix Bookings. The business's customers join a waitlist on the service page of the business's website. When a booking is cancelled or rescheduled, matching waitlisted customers receive an offer with a booking link, and the first person to book gets the slot. The slot is not held for anyone.

License

We grant the business owner a license to use the App for as long as it is installed on their site.

The business owner's responsibilities

  • The business owner has consent to contact the customers who join the waitlist.
  • The business owner complies with the privacy and marketing-message laws of their country.

Plans and payments

  • Free: notifications to the business owner only.
  • 14-day trial from installation: automatic email offers, up to 100 emails, no credit card.
  • Basic and Pro: paid monthly or yearly.

Payments are made through Wix, under Wix's terms, and cancellations and refunds are also handled through Wix. You can cancel at any time. WhatsApp messages may be added later.

Limitation of liability

  • We do not guarantee that every opened slot will be filled.
  • We do not guarantee uninterrupted availability of the App.
  • We are not liable for indirect damages.

Privacy

How the App handles data is explained in the App's privacy policy.

Changes to these terms

We will give advance notice of changes to these terms on this website.

Governing law and jurisdiction

These terms are governed by the laws of Israel, and the courts of Israel have jurisdiction.
